have u tried to feed him yet?, its very distressing to see any type of snake in that condition.
Do you have any evidence that he said that the snake would be in good condition when received?

The guy sold them to me as a trio. He said they were all healthy, and that there was one a little smaller than the other two. He didn't say it was emaciated or anything.
