OMG I AM soooooo angry I am shaking!!!!!!!

Ok, so 5 months ago we rented and moved into a property. The back yard has not been landscaped and it is a mud pit and weeds ( we literally had to mow the weeds the other day) we were promised that the back yard would be landscaped 2 weeks after moving in…. 5 months later and we still have no back yard….

They were booked into complete the back yard this weekend but due to their previous history of cancelling every week I rang our real estate to confirm. She called me back and said no they are cancelling again….
She then said to me “ oh, the owners wanted me to ask why there is a dog kennel in the back yard” I replied with “ I beg your pardon? No1 – there is no dog kennel in the back yard there is a rabbit hutch and no 2 when and why were they in our back yard without our permission?? That is illegal!!!!”
She replied with “ yes I know, I will talk to them about that”…….

That’s it, I have had enough and I am taking them to the tribunal. I have an appointment today at 1 with my solicitor to find out what our rights are.
We are good tenants, we maintain our house, we pay our rent religiously, we even pay extra when we can in case we are ever behind.
I cannot believe this and I’m furious and need to vent!!!!!!!!!
 
That sucks! Im glad the owner of my property is a 'take your word for it' kinda bloke, ive been here 3yrs now & never had an inspection. Mind you though, when it comes to fixing anything........he isnt interested. We use lamps in almost all rooms, cause the wiring is that bad that the light bulbs blow in the fittings, we also have a 12ft deep inground pool out the back that we refer to as the 'swamp'........cause that is all it is, we cant use it at all, we have the council out constantly checking if he has done anything with it.......& still nothing! A friend of mine just had an inspection though at her place, & she came home to a note on the kitchen bench asking that she tidy her clothes up in her wardrobe! :? An inspection that went further obviously then it should have!

They really can't come and go as they please like that. I'm sure the law is on your side. Allowing a tenant privacy on property they pay good rent for should be a given. The annoying thing about "some" landlords is that they have an amazing ability to be so impersonal and rude, especially when they start using the real estate agent as their "muscle".

I've had some doozey run-ins with landlords back in the day. Real estate agents also hold a special place in my heart as well :lol:

Mate bad news for you.

Good tenant or not, it means nothing.
We had issues with our realestate and owners and the only thing that we could do was put a breach in. We did that and something came out of it, though I asked the realestate what would happen if it wasn't resolved and she said we could move out without loosing any bond or rent etc etc. Load of though cause when the Tenant gets a breach its "your out and you loose rent until we find someone else" sort of .
I wish you good luck but unfortunately don't expect things to go 100% of your way. Its very unfortunate and I know your pain.
On the up side they entered your property without permission. Thats a lawsuit there. So maybe an agreement could come to play...lets say you won't press charges if they "get THEIR act together and fix the lawn" ??? :D

We got a breach back in Gladstone for Dirty windows and weeds on the garden. It was cleaner then when we moved it. But the house was renting for cheap and the realestate was trying too kick us out for breaching it (later when we moved out rent went up $150-Theres a big crisis in Gladstone atm). After we got the breach I took photo's went to the realestate and went nuts at them. Went made ay. Told them i know my rights and if they try and pull this again I will be taking them to court. Never again did they hassel us :) and we got 100% of our bond back 6 months later without any issue :)

Good luck and sorry about my rant though until recently we have never had much luck lol

ages ago when we wanted a back yard i read up on our rights and was told that we were intitled to some money back as we " were not able to get full enjoyment from the property as per lease "
i just had a quick read of the one kurto sent and this bit is what they have done - no consent and no emergency
[h=2]Entry without consent, without notice[/h]The landlord/agent or another person authorised by the landlord can enter the premises without your consent and without notice, only:
  1. in an emergency
  2. to carry out urgent repairs (see Factsheet 06: Repairs and maintenance)
  3. if the landlord has reason to believe the premises have been abandoned
  4. in accordance with an order of the Consumer, Trader and Tenancy Tribunal (CTTT)
  5. if after making a reasonable attempt to gain consent, the landlord/agent or authorised person has serious concern about the health/safety of a person on the premises.
Except in the case of (e) above, the ‘Limits to entry without consent’ (see below) do not apply.
im trying to fina an ACT one as i think they are different.

skelhorn i hope our luck is better then yours.
the reason why i originaly didnt take it further after waiting 5 months for the yard was because i was worried that if we took it further they would make it hell for us to live there and even try to kick us out. but today they have gone to far
 
The simple solution is to purge the weeds with fire then tell them it was like that when you got there.

yeah I wish you good luck. If you show turn around though and don't take any of the realestates crap you might come out on top. Tell them you know your rights bla bal bla and don't stand down. Other option is take it to the RTA/or higher.

GET EVERYTHING IN WRITING.

Stop ringing the real estate, and start emailing them if you want a case.
I broke a lease this year, and my landlord turned down a perfectly good tenant, because they were indian.
I couldn't get them to put it in writing, as I was told over the phone, and had no case.

There's also probably very little you can do about the backyard if it isn't written into your lease agreement that you're renting the property on the condition that the backyard will be fixed.

As for them coming into your yard, email the real estate about it, and word it so that they admit that it happened, otherwise you have no case their either.

I've had horrible housemates, horrible real estate agents, and horrible landlord who go back on everything they say.
Unless they say it in writing, and you can prove it, there is NOTHING that anyone can do about it.

Good luck with it, but if I were you, I'd be breaking the lease and getting out, or waiting till the end of the lease and moving out.

My aunty has a house in Scullin. She has since "moved" to parkes to work on some kind of property/farm and we were told we could move in and pay $170 a week rent. That included Internet, phone, Gas and electricity aswell.
But we had to look after the house and hold some of her belongings and both her cats.
She has since invited people into the house while my fiancé and I were at work to look at our reptiles and our rabbits. There was no consent given, and we did not find out about it until my fiancé got home to find my aunty had left something behind. That's one occasion, who knows how many others there were. I found out a week ago we have to move out on the 25th and that it's a government house. These were all questions I asked in the beginning, but turns out now she didn't understand my questions.....
I know how you feel, I really do. So make sure you get this sorted so it's best for you and your partner.

ok, just got bk from lawyer, have been advised to go to the tribunal, will write a proper update asap :)

I was living with a band in the 80's and we rented this old dump off a nice old greek fella. One day we came home and he was standing by a bonfire in the back yard. He happily informed us that he had cleaned up all the rubbish and was obviously expecting a big pat on the back and a couple of beers.

The rubbish included most of our clothes, musical instruments, art works, photographic paper, posters, even furniture, etc etc.
We were wild but couldnt do much, he was a sweet old guy genuinely trying to help!

Looking back now, he was probably right!!!
