he called the apropriate people to come get them as he was scared someone was coming round to trash his house and beat the piss out of him, this was said on the news last nite as he said he broke up with his gf or something and she was sending people round to visit him.

And that poor sap at Nyngan 3 weeks ago copped $6000 for 2 fierce snakes because he had a RK licence. Wonder why so many people laugh when you question the keeping of exotics or illegal natives.

wrong class rk ??? :?

No they were wild caught without the permits so he did deserve what he got, but I was refering to the fact that if he was not licenced he would be up for somewhere in the vicinity of $300. Much the same deal as what our Burm and monkey dude has got.

I suppose they expect licensed folk to know better, still same fine should apply to unlicensed, cant have double standards. I understand now, thanks for clarification.

I think the touted "max penaltys" must the the equivalent of a big stick, i.e threat, smuggling would probly get the stick if convicted though, they must know they wont get $100G from a little fish.

Ok For those who may not know, caveleri's animals were discovered when he invited police into his home on another matter, he claimed to be ignorant of the licencing laws and if you ask me he has many friend higher up. Hi did plead guilty, and with the prosecutions recommendation he received a 1000 dollar fine after promising the judge he would now be trying to obtain the proper licence and keep only the animals that licence allowed him to. He was a real sweet talker apparently.

He did not call anyone. I called the zoo and passed the info on to Stuart who called his superviser.
The police called me initially.

I think the $1000 fine is about right judging by other cases. He seemed to have looked after the animals well which would have gone in his favour. Nice looking Burmese. :)

how could they tell the taipans were wild caught?

I live near Bondi and around that Waverly and i know that some dicey stuff goes around there. In fact i can probably have a geuss at where he got them. At least he looked after them!

Regards Alex

WA you risk maximum of $15000 if proven you removed animals illegally and kept them illegally. You dont want to be caught here. CALM vigourously persue and prosecute.

Read in the telegraph today that his monkey was legally kept as he has a primate licence...how the HELL does one go about getting one of those? :) That would be awesome.

Found bagged in the console of his vehicle and then I guess his log books really put him in the brown stuff.

The maximum penalty is the maximum that the individual can be penalised (obviously), and it's set by the Federal Government. However, if an individual is found guilty, the judge can set whatever penalty he/she chooses. When deciding the penalty, the judge takes into account all the mitigating factors.

Having said that, there have been other cases where the fines have been ridiculously small. I'm not convinced we have judges who are as environmentally conscious as the rest of us.

And as far as not being able to pay a huge fine, the judge can put him in jail instead - up to 5 years.

:p
